Privacy policy

This page explains what personal information this website collects, why, and the choices you have. In short: I use what you send me to reply to you and, if you go ahead, to handle the sale, purchase or charter. If you sign up for updates, I use your email address to send them. This site does not use cookies, analytics or advertising trackers.
Who is responsible
Holmes on Board is the personal website of Martin Holmes, a yacht broker based in Phuket, Thailand. I am responsible for the personal information you send through it. For anything to do with your information, email martin.holmes@northropandjohnson.com.
What I collect
- What you send through the enquiry form: your name, email address, phone number if you give one, what you would like help with, how you would like me to reply, any yacht you mention and your message.
- Your email address, if you sign up for updates with “Stay updated” at the foot of each page.
- What you send me directly by email, phone or WhatsApp.
- Basic technical information that any web server records: your IP (internet protocol) address, your browser type, the pages you asked for and when.
This website does not set cookies, run analytics or embed third-party tracking.
Why I use it
- To reply to your enquiry and provide the service you asked about.
- To send you the occasional updates you signed up for, and nothing else.
- To keep the website secure and working, and to stop the enquiry form being abused.
- To meet legal, accounting or regulatory duties connected with a sale, purchase or charter.
Where the law asks for a legal basis, I rely on your request (taking the steps you ask for before any contract), on your consent for the updates you sign up for, on my legitimate interest in answering enquiries and keeping this site secure, and on the legal duties that come with a transaction.
I will not send you marketing you have not asked for, and I never sell your information.
Where it goes and who sees it
Enquiries from the form, and sign-ups for updates, are emailed to my Northrop & Johnson mailbox, which Northrop & Johnson runs on Microsoft 365. The website is hosted by Hetzner in Germany, where the server also keeps a backup copy of each one in case an email goes astray.
If you go ahead with a sale, purchase or charter, it may be handled through Northrop & Johnson or Lee Marine, and their own privacy notices then apply too. The details needed to complete it may also be shared with others involved, such as surveyors or the other party’s broker, and only as far as necessary.
Updates by email
When you sign up, the website emails your address to me and I add it to the list I send updates from. The website itself keeps no mailing list, only the backup copy described above. Your address is used for these updates and nothing else.
To stop them, reply to any update or email martin.holmes@northropandjohnson.com, and I will take you off the list.
How long it is kept
The backup copy of an enquiry or sign-up on the web server is deleted automatically after 90 days. If you sign up for updates, your address stays on my list until you ask me to remove it. The server’s technical logs are kept for security and troubleshooting, and older logs are deleted automatically. Emails and records of any business that follows are kept only as long as needed for it, or as long as the law requires, and are then deleted.
Your rights
Depending on where you live, you have rights under Thailand’s Personal Data Protection Act and under the UK and EU General Data Protection Regulation (GDPR). You can ask to see the information held about you, and to have it corrected or deleted. You can also object to or restrict its use, or withdraw consent you have given.
Email martin.holmes@northropandjohnson.com and I will respond promptly. You can also complain to your local data protection authority. In Thailand that is the Personal Data Protection Committee.
Changes
If this policy changes, the new version will be published here with a new date.
